Lots Platted Prior to New IRC Rollout Grandfathered Into Old IRC

On December 26, 2019, the new Residential Code was released, presenting substantial changes to the current version of the Code, which has been in place since 2005. Local training has been offered to help builders, suppliers, design professionals, realtors, and appraisers understand this new Code, and in addition, the Building Department is committed to collaborating with these parties as the aspects of the new Code are adopted and enforced.

All this being said, there have been recent concerns regarding the new requirements for side yard setback for fire protection. We are pleased to communicate that any lots that were platted at the time of the new Residential Code being released will be grandfathered under the old IRC. Allen County Building Commissioner John Caywood is currently working with the Department of Planning regarding improving location permits so that they will be approved.
Moving forward, the new Code will allow increased safety protocol amidst its changes to ensure that new builds are executed with the utmost safety.
