If you have sold a home in Allen County since March 1, 2012 that was served by an onsite sewage system (septic) and you (the seller) did not complete the new “Seller Disclosure Form for Properties Served by Onsite Sewage Systems” required by the Fort Wayne-Allen County Board of Health, you would be in non compliance with a local ordinance. The state “Seller’s Disclosure” form is not sufficient according to the Allen County Board of Health to disclose the existence of an onsite sewage system. All sellers must fill out Allen County’s septic system disclosure form, which recommends that the prospective buyer have the septic system evaluated before purchase. The language on the form reads as follows:
“This disclosure form is to alert the buyer that the property is not served by a public sewer and that the Fort Wayne – Allen County Department of Health recommends that the buyer retain a qualified individual to evaluate any Onsite Sewage System prior to closing the sale transaction.”
This provision to alert prospective buyers of a septic system was instituted because the Fort Wayne-Allen County Department of Health estimates that approximately 70 percent of septic systems may be failing, which is a threat to public health. The department’s intention is to have more systems evaluated and repaired prior to sale to lessen the chance of a potential public safety issue.
